Terms of Service

1. Acceptance of Terms

These Terms of Service (these "Terms") are entered into between Cuiheng Tian, an individual developer with a place of business in China (referred to as "we," "us," or "the Developer"), and the user who uses the CuraBite AI service (referred to as "you" or the "User").

By registering, logging in, accessing, or otherwise using the CuraBite AI service (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to any part of these Terms, please stop using the Service immediately.

2. Description of Service

CuraBite AI is an artificial intelligence-powered pet food ingredient analysis application that provides the following features:

  • AI-powered scanning and intelligent analysis of pet food ingredient labels
  • Ingredient nutrition encyclopedia lookup
  • Daily calorie calculation and intake tracking for pets
  • Multi-pet health profile management
  • Personalized feeding recommendations

The Service is a digital SaaS (Software as a Service) product offered through the website curapet.pages.dev and accompanying applications.

3. Account Registration

3.1 Registration Method

You may register a CuraBite AI account using an email address. A valid email address and a password are required at the time of registration.

3.2 Account Security

You are solely responsible for your account password and for all activities that occur under your account. Please safeguard your account information and never lend it to others. You bear all losses arising from any disclosure of your account credentials.

3.3 Guest Mode

The Service offers a guest mode that allows you to experience certain features without registration. Data generated in guest mode is stored only in your local browser, is not uploaded to the cloud, and is not synchronized across devices. Clearing your browser data will permanently delete guest-mode data.

4. Subscription Plans (V1)

The current version (V1) of the Service offers the following plans:

  • Free Plan: Provides basic ingredient scanning and lookup features, and may be subject to usage limits or feature restrictions.
  • Premium Subscription: Provides the full set of advanced features, including unlimited AI analyses, the complete nutrition encyclopedia, multi-pet profiles, calorie tracking, and more.

The Premium Subscription is offered in both monthly and annual billing cycles. Specific pricing, feature differences, and promotions are displayed in real time on the subscription page.

5. Billing and Payment (V1)

5.1 Automatic Renewal

By selecting a Premium Subscription, you authorize us to automatically charge your designated payment method for the next billing cycle when each cycle expires, until you actively cancel the subscription.

5.2 Payment Processing

Payment processing for the Service is provided by Waffo Pancake. Your payment information (including card numbers, etc.) is securely processed and stored by Waffo Pancake. We do not access or store your complete payment credentials.

5.3 Taxes

Subscription fees may include applicable value-added tax, sales tax, or other taxes. The specific tax amount is displayed on the checkout page. Taxes are determined based on your region and applicable law.

6. Cancellation Policy (V1)

You may cancel your Premium Subscription at any time using the following methods:

  • Online cancellation: Log in to your account → Account Settings → Subscription Management → Cancel Subscription.
  • Email cancellation: Send a cancellation request to tiancuiheng@gmail.com, including your registered email address.

After a successful cancellation, your currently paid subscription cycle will remain active until its expiration date. Upon expiration, no further charges will be made and your account will automatically downgrade to the Free Plan. Fees already paid are non-refundable, except as otherwise provided in Section 7 of these Terms.

7. Refund Policy (V1)

7.1 First-Time Subscription Guarantee

For first-time Premium subscribers, within 7 days from the date of the first charge, you may request a full refund if you have not actually used the premium features or are unsatisfied with the Service. The first-time guarantee refund is available only once per user.

7.2 Duplicate Charges

If a duplicate charge occurs within the same billing cycle due to a system fault or operational error, we will fully refund the duplicated portion.

7.3 Service Interruption

If the Service is continuously interrupted for more than 72 hours due to causes attributable to us, you may request a pro-rata refund of the subscription fee corresponding to the interruption period.

7.4 Statutory Rights Reserved

This refund policy does not affect any statutory consumer rights you may have under applicable law. In the event of any conflict between this policy and mandatory legal provisions, the legal provisions shall prevail.

8. Billing Disputes

If you have any questions or disputes regarding billing amounts, charge records, or subscription fees, please contact us at tiancuiheng@gmail.com within 60 days of the charge. We will verify and respond within a reasonable period after receiving your claim. Disputes raised after this period may not be accepted.

9. AI Content and Intellectual Property

9.1 Third-Party AI Models

The ingredient analysis and recognition features of the Service are powered by third-party AI models (visual recognition and ingredient analysis). The analysis results generated by the AI are automatically produced by the model based on input data and may contain deviations or inaccuracies.

9.2 Content for Reference Only

AI-generated analysis reports, nutritional recommendations, and other content are provided for your reference only and do not constitute veterinary diagnosis or professional feeding advice. Before making any important decisions concerning your pet's health, please consult a licensed veterinarian.

9.3 Ownership of Output Content

Scan records, analysis reports, pet profiles, and other content you generate through the Service belong to you. Provided that you use the Service in compliance with these Terms, the Developer grants you the right to use, copy, and export such content.

9.4 Service Intellectual Property

The software, interface, icons, copy, algorithms (other than the third-party AI models), and other intellectual property of the Service are owned by the Developer or its rights holders. Without written permission, you may not copy, modify, distribute, or use them for commercial purposes.

10. Acceptable Use Policy

When using the Service, you agree not to engage in any of the following:

  • Using the Service to generate, store, or distribute any illegal, harmful, harassing, defamatory, or rights-infringing content;
  • Using AI features to create deepfake content, or using generated results in a misleading or fraudulent manner;
  • Infringing the intellectual property rights of others, including uploading unauthorized copyrighted materials;
  • Reverse engineering, decompiling, cracking, or attempting to bypass any usage restrictions of the Service;
  • Scraping Service data in bulk through automated scripts, crawlers, or otherwise, or interfering with the normal operation of the Service;
  • Sharing, renting, or transferring your account to third parties.

If we find that you have violated the above provisions, we may restrict, suspend, or terminate your account access at any time and reserve the right to pursue legal liability.

11. Data, Privacy, and Security

We value the protection of your personal information and privacy. For information about how we collect, use, store, and protect your data, please refer to our Privacy Policy.

The key data-handling points relevant to these Terms are as follows:

  • Payment data is processed and stored by Waffo Pancake, and we do not access sensitive payment information such as your full card number;
  • After canceling your subscription, your account data will be retained for 90 days, during which you may resubscribe to restore access;
  • After the retention period expires, we will delete or anonymize your relevant data within a reasonable period, unless otherwise required by laws and regulations.

12. Disclaimer and Limitation of Liability

12.1 Not Professional Advice

The AI analysis content provided by the Service is for informational reference only and does not constitute veterinary diagnosis, treatment advice, or professional feeding opinion. Pet health conditions vary by individual, and any feeding decision should be made in conjunction with professional veterinary advice. We are not liable for any losses arising from reliance on AI analysis results.

12.2 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis. We make no express or implied warranties regarding the availability, accuracy, completeness, merchantability, or fitness for a particular purpose of the Service.

12.3 Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service. For any direct damages, our cumulative liability shall be limited to the subscription fees actually paid to us by you in the 12 months preceding the event giving rise to the dispute.

13. Term and Termination

These Terms take effect when you begin using the Service and remain in effect until terminated by you or us.

You may terminate these Terms at any time by deleting your account or ceasing to use the Service.

If you seriously breach these Terms, fail to pay fees due, or where required by law, we may suspend or terminate the Service to you and cancel your account.

Upon termination of these Terms, Section 9 (Intellectual Property), Section 12 (Disclaimer and Limitation of Liability), Section 14 (Governing Law), and Section 15 (General Terms) shall remain in effect.

14. Governing Law and Dispute Resolution

The formation, validity, interpretation, performance, and dispute resolution of these Terms shall be governed by the laws of the People's Republic of China (excluding its conflict-of-laws rules).

Any dispute arising from or relating to these Terms or the Service shall first be resolved through friendly negotiation between the parties. If negotiation fails, either party may bring a lawsuit before a people's court with jurisdiction over the Developer's place of business.

15. General Terms

15.1 Changes to Terms

We may revise these Terms from time to time. Revised Terms will be posted on curapet.pages.dev with an updated effective date. For material changes involving subscription fees, core service scope, and similar matters, we will notify you in advance via your registered email or in-product notification. Continued use of the Service constitutes acceptance of the revised Terms.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the invalidity of that provision shall not affect the remaining provisions, which shall remain in full force and effect.

15.3 Entire Agreement

These Terms (together with the referenced Privacy Policy) constitute the entire agreement between you and us regarding the use of the Service, and supersede all prior oral or written communications and understandings.

15.4 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing to be effective.
